1. PROTECTING YOUR PRIVACY

1.1. This privacy statement provides information about the personal information that we collect, and the ways in which we use that personal information.

1.2. Your privacy is important to us. We comply with the Privacy Act 1988 (Privacy Act) when we handle personal information. The Privacy Act contains 13 Australian Privacy Principles (APPs) which provide the rules for how we must handle your personal information, including how you can request access to, and correction of, that information. 1.3. We will only use or disclose personal information we hold about you in accordance with this Privacy Policy or as otherwise notified to you.

2. ACCEPTANCE OF TERMS

2.1 This privacy policy governs the manner in which Pragyaam Data Technologies Private Limited and Expedio Services Pty Ltd ACN 144 662 760 (“Expedio” or “we” or “us”) including its affiliates and subsidiaries (collectively “Company”) collects, uses, maintains and discloses information collected from users (each, a “User” and together, the “Users”) of the name “www.rock-it.cloud” website or its mobile/web applications and services offered by the Company (collectively “Website and Application”). This privacy policy applies to the Website and Application and all services offered by the Company. The Users agree to and are bound by the terms and conditions set forth below and in any modified or additional terms that the Company may publish from time to time (collectively, the “Privacy Policy”).

2.2 If the User accesses or uses the Website and Application, the User agrees to all of the terms and conditions contained in the Terms of Use and this Privacy Policy.

3. PERSONAL INFORMATION

3.1. “Personal Information” is information about an individual who is either identified in the information or their identity can be ascertainable from it. It includes information and opinions obtained from the individual or from a third party.

3.2. The Personal Information collected, received, processed, stored, dealt or handled by the Company includes, name, contact details, unique identifiers, email address.

3.3. The Company may collect Personal Information from Users in a variety of ways, including, but not limited to, when Users visit the Website and Application, registers on the Website and Application, place an order and in connection with other activities, services, features or resources the Company makes available on the Website and Application. Users may be asked for, as appropriate, their name, email address, mailing address, phone number.

3.4. When a User uses the Website and Application, the User’s Personal Information is collected and held by us and may be made available to any entity that provides the User with access to the Website and Application (“Corporate User”).

3.5. The Users’ Personal Information that is obtained by the Corporate User via the Website and Application must be collected and held in accordance with this Privacy Policy.

3.6. The Company will collect personal identification information from Users only if they voluntarily submit such information to the Company. Users can always refuse to supply Personal Information, however, it may prevent them from engaging in certain Website and Application- related activities.

4. NON-PERSONAL INFORMATION

The Company may collect non-personal information about Users whenever Users interact with the Website and Application. Non-personal information may include the browser name, the type of computer and technical information about Users’ means of connection to the Website and Application, such as the operating system and the internet service providers utilised and other similar information.

5. USE OF THE INFORMATION COLLECTED

5.1. The Company does not ordinarily collect any information about Users except where the Users provides it or where it is provided to the Company with consent. In general, the Company does not use or disclose Personal Information collected about the User, other than for:

(a) a purpose set out in this Privacy Policy;

(b) a purpose the User would reasonably expect;

(c) a purpose required or permitted by law; or

(d) a purpose otherwise disclosed to the User or for which the User has consented.

5.2. The User’s Personal Information may be used by the Company and a Corporate User to:

(a) verify the User’ s identity;

(b) price and design products and services;

(c) assist the User to subscribe to products and services;

(d) provide the products and services which the User requires;

(e) provide the User with access to the Website and Application;

(f) notify the User of new or changed services;

(g) arrange for the products and services the User require to be provided by third party service providers;

(h) manage the Company’s relationship with the User;

(i) administer, improve and manage their products and services, including charging, billing and collecting debts;

(j) research and develop a Corporate User’s products and services;

(k) carry out marketing or training;

(l) comply with the laws and regulations in applicable jurisdictions; and

(m) maintain and develop their business systems and infrastructure.

5.3. The Company uses the Users’ Personal Information for the following purposes:

(a) to fulfil any orders placed through the Website and Application (including processing the User payment information and providing the Users with invoices and/or order confirmations);

(b) to identify the User once it registers on the Website and Application;

(c) to create the User login and administer the User accounts;

(d) to contact the User and respond to the User’s questions or requests;

(e) to send the User communication regarding the services and products;

(f) to provide access to desirable content and products based on the User’s preferences;

(g) to provide better usability, troubleshooting and site maintenance;

(h) to understand which parts of the Website and Application are visited and how frequently;

(i) to screen the orders for potential risks or fraud; and

(j) to improve and optimise the Website and Application (for example, by generating analytics about how the User’s browse and interact with the Website and Application, and to assess the success of the Company’s marketing and advertising campaigns).

6. SHARING OF USER’S PERSONAL INFORMATION

6.1. The Company may exchange the User’s Personal Information with its related bodies corporate. The Company and its related bodied corporate may use this information for any of the purposes outlined in section 4 of this Privacy Policy.

6.2. The Company may also disclose Personal Information about the User, as appropriate, to:

(a) Corporate Users and their employees, assignees, agents, referred service providers, contractors and external advisers;

(b) the Company’s employees, assignees, agents, referred service providers, contractors and external advisers;

(c) organisations which verify the User’s identity;

(d) the User’s agents, advisers, referees, executor, administrator, trustee, the beneficiary of any trust of which the User is a trustee, the User’s guardian, attorney or franchisor;

(e) law enforcement, regulatory and government bodies;

(f) anyone who introduced the Company to the User;

(g) the User’s and the Company’s auditors, insurers or prospective insurers and their underwriters;

(i) other organisations (and their agents) with whom we have arrangements for the supply and marketing of our respective products and services, unless the User ‘opts out’ of marketing.

6.3. From time to time, the User’s information may be sent overseas, including to overseas service providers or other third parties who operate or hold data outside Australia. Where the Company does this, we make sure that appropriate data handling and security arrangements are in place. Please note that Australian law may not apply to some of these entities.

6.4. The Company may share the User’s information with third parties for the purposes outlined in section 5 of this Privacy Policy where the User has given the Company permission. If the User accesses those links, the User will leave the Website and Application. The Company does not control those sites or their privacy practices, which may differ from the Company. The Company does not endorse or make any representations about third-party sites.

6.5. The Users’ information may also be shared internationally in accordance with applicable law.

6.6. The Company is not responsible for examining or evaluating, and does not warrant the offerings of, any businesses or individuals or the content of their website. The Company does not assume any responsibility or liability for the actions, products, services, and content of any other third parties. Users should carefully review the legal statements and other conditions of use of any website which the User accesses through a link from this Website and Application. The User linking to any other off-site websites is at the User’s own risk.

6.7. The Company may use third-party service providers to help the Company operate its business and the Website and Application or administer activities on the Company’s behalf, such as sending out newsletters or surveys.

7. MARKETING ‘OPT OUT’

If, at anytime, the User does not wish to receive further marketing information, the User may ask the Company not to send any further information about services and not to disclose the User’s information to other organisations for that purpose. 8. PERSONAL INFORMATION ABOUT THIRD PARTIES

If the User provides the Company with Personal Information about another person, the User represents that they are authorised to do so and agrees to inform that person who the Company is, that we may use and disclose their Personal Information and that they may access any Personal Information the Company holds about them. The User should also refer them to this Privacy Policy which governs how that person’s Personal Information may be used or disclosed by the Company.

9. MAINTAINING THE ACCURACY OF THE USER’S INFORMATION

The Company takes all reasonable precautions to ensure that the Personal Information collected, used and disclosed is accurate, complete and up-to-date. 10. ACCESSING THE USER’S PERSONAL INFORMATION

Users have a right to access their Personal Information, subject to some exceptions allowed by law. If the User would like to do so, please let Expedio know by contacting us at Hello@rock- it.cloud. The User may be required to put their request in writing for security reasons. The Company may also charge a fee for providing access to Personal Information and will try to deal with the User’s request within a reasonable time.

11. IDENTITY THEFT

There may be instances when the User receives a seemingly legitimate looking e-mail asking for the User’s Personal Information such as the User’s credit card details, bank account details, one- time passwords, contact information, etc. The Company will never ask for such information from the Users via e-mail.

12. WEB BROWSER COOKIES

12.1. A cookie is an element of data that a website can send to the User’s browser, which may then be stored on the User’s system. The Company uses cookies in some of its pages to store visitors’ preferences and record session information. The information that the Company collects is then used to ensure a more personalised service level for the Users.

12.2. The User can adjust the settings on its browser so that the User will be notified when it receives a cookie, or to disable the cookies associated with the Website and Application. The User should refer to its browser documentation to check if cookies have been enabled on the User’s computer or to request not to receive cookies.

12.3. The Website and Application may use “cookies” to enhance Users’ experience. The User’s web browser places cookies on their hard drive for record-keeping purposes and may track information about them. Users may choose to set their web browser to refuse cookies or to alert the User when cookies are being sent. If they do so, note that some parts of the Website and Application may not function properly.

13. DATA RETENTION

13.1.  The Company will retain the Users’ information only for as long as is necessary for the purposes set out in this policy. The Company will retain and use the Users’ information to the extent necessary to comply with the Company’s legal obligations (for example, if the Company is required to retain the Users’ data to comply with applicable laws), resolve disputes, and enforce the Company’s legal agreements and policies.

13.2. The Company encourages the User to review the information and inform about any discrepancies and information found to be inaccurate shall be corrected or amended. The User shall at all times, take adequate necessary precautions, at the User’s end, to preserve the integrity and security of the User’s data which shall include and not be limited to the User’s Personal Information. All information disclosed by the User has been disclosed willingly and without any coercion.

14. LOG DATA

The Company informs the User that whenever the User uses the Website and Application or the Company’s services, the Company collects data from the User device called log data (“Log Data”). This Log Data may include information such as the User device’s internet protocol (“IP”) address, device name, operating system version, configuration of the app when utilising the Website and Application services, the time and date of the User’s use of the Website and Application service, and other statistics.

15. INFORMATION SECURITY

The Company works to protect the User’s information from loss, misuse or unauthorised alteration by using industry-recognised security safeguards, coupled with carefully developed security procedures and practices. The Company maintains electronic and procedural safeguards of all information. The Company uses both internal and external resources to review the Company’s security procedures. The security practices and procedures contain managerial, technical, operational and physical security control measures that are commensurate with the Personal Information being collected, received, processed, stored, dealt or handled and the nature of the business of the Company.

16. DISCLAIMER

16.1. The Company makes no representation as to providing or storing back-up copies of any information submitted to the Company. The User shall be solely responsible to ensure that the User maintain back-up copies of such information and, in the event of any malfunctioning or failing of the Website and Application for any reason whatsoever (including on account of maintenance), the User may be required to resubmit such information.

16.2. Although, the Company take appropriate steps to maintain the security of information the Company collects from the User, the Company assumes no responsibility of whatsoever nature as to make good the losses and damages the User may incur, due to privacy and/or security breach of the User information. The Company shall not be liable for any loss or damage sustained by reason of disclosure (inadvertent or otherwise) of any information and/or omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.

17. USE OF THE WEBSITE AND APPLICATION

17.1. The User understands that, except for information, products or services clearly identified as being supplied by the Company, the Company does not operate, control or endorse any information, products or services on the internet in any way. Except for the Website and Application, identified information, products or services, all information, products and services offered through the Website and Application or on the internet generally are offered by third parties that are not affiliated with the Company. The User also understand that the Company cannot and do not guarantee or warrant that files available for downloading through the Website and Application will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. The Users are responsible for implementing sufficient procedures and checkpoints to satisfy the Users’ particular requirements for accuracy of data input and output, and for maintaining a means external to the Website and Application for the reconstruction of any lost data.

17.2. The User assumes total responsibility and risk for the User’s use of the Website and Application and the internet. The Company provides the Website and Application and related information “as-is”, and does not make any express or implied warranties, representations or endorsements whatsoever (including without limitation warranties of title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to the service, or on the internet generally. The Company shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. It is solely the User’s responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services, merchandise and any other information provided through the service or on the internet generally. The Company does not warrant that the service will be uninterrupted or error-free or that defects in the service will be corrected. The Users acknowledge that the pure nature of the internet contains unedited materials some of which are sexually explicit or may be offensive to the User. The User’s access to such materials is at the User’s own risk. The Company has no control over and accept no responsibility whatsoever for such materials.

18. GENERAL

18.1. The User may choose to withdraw its consent provided hereunder at any point in time. Such withdrawal of consent must be sent in writing to [email protected]. Where a User withdraws its consent, the Company directs the User not to access the Website and Application and reserves the right to not provide the User with any services through the Website and Application.

18.2. The Company provides links to other websites and third-party platforms (“Third-Party Platforms”). Such Third-Party Platforms may collect information about the User. The Company is not responsible for the privacy practices or the content of those linked websites and Third- Party Platforms. The Company recommends that the User reviews the privacy policies of such Third-Party Platforms.

18.3. The Website and Application has the discretion to update this privacy policy at any time. The Company encourages Users to frequently check this page for any changes to stay informed about how the Company is helping to protect the Personal Information it collects. The User acknowledges and agrees that it is the responsibility of the User to review this privacy policy periodically and become aware of modifications.
